Regulations
TERMS OF ENTRY:
(a) By participating in this Contest, Contestant warrants that his or her entry, as submitted, and all elements thereof,
(i) do not infringe or violate the rights of any third party, including but not limited to, copyrights, trademarks, patents, trade secrets, logos, contract and licensing rights, rights of publicity or privacy, moral rights, or any other intellectual property rights;
(ii) are not subject to any third party agreements for which the Catfish Creek Conservation Authority could be held financially or legally liable;
(iii) do not contain any content that could adversely affect the name, reputation, or goodwill of any person, corporation, or entity, including the Catfish Creek Conservation Authority. Contestant agrees to indemnify the Catfish Creek Conservation Authority against all damages, costs, and attorney’s fees related to any claims or litigation that arises in relation to Contestant’s participation in the Contest; and,
(iv) any submission, including all elements thereof, is an original work.
(b) The Contestant retains the copyright and exclusive possession of all submissions. The Contestant will grant to the Catfish Creek Conservation Authority the nontransferable, nonexclusive license to use, with complete attribution and via any medium, the submission for promotional or other purposes as deemed fit by the Catfish Creek Conservation Authority.
(c) Usage rights for the submission, including all elements thereof and further including any and all associated digital adaptations thereof (digital editions/tablets/interactive digital magazines), the right to modify (minor retouching/color correcting) of photography/illustration as needed (with permission from the artist) and the nonexclusive right to publish any such photography/illustration within its publications is granted irrevocably to the Catfish Creek Conservation Authority for purposes of promotion of the Catfish Creek Conservation Authority. These usage rights as granted to the Catfish Creek Conservation Authority shall commence on the date of submission to the Catfish Creek Conservation Authority and apply during the publication/distribution lifespan on the publication within which the submission or any element thereof is published.
(d) The winning artist will receive an artist attribution wherever the submission or any element thereof is published.
(e) All submissions must be high-resolution images, suitable for printing. All image submissions must be a minimum size of 5.5” x 8.5” at 300 dpi. Please note the images pulled directly from websites or social media platforms may not meet the stated requirements/specifications.
(f) Neither the Catfish Creek Conservation Authority nor any of their respective affiliates, partners, contractors, subcontractors and each of their respective officers, directors, shareholders, agents, and employees, nor any Internet access providers are responsible for incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, lost/delayed/misdirected mail, omission, interruption, deletion, defect, line failure of any telephone or other network, computer equipment, software or any combination thereof, inability to access the contest website, for problems uploading or downloading any contest-related materials from the contest website, or for late, lost, damaged, misdirected, incorrect or incomplete entries.
(g) All entries must be submitted to and received by the Catfish Creek Conservation Authority no later than 11:59 pm (EST) on January 15, 2024. Proof of transmission or posting is not proof of receipt. Any entry information collected from the Contest may be recorded by the Catfish Creek Conservation Authority for further promotional or marketing purposes.
